State Bar documents. In 1989, Daye wanted to practice law in North Carolina. The Board of Law Examiners asked for a mental assessment, and Daye's psychiatrist, Jean Spaulding of Durham, wrote a letter saying Daye could function as a lawyer. "She is on appropriate medication for her condition and will continue to take this medication for an indefinite period of time," Spaulding wrote. "As long as Ms.

Daye continues her medication as prescribed, there should be no negative change in her mental status." Spaulding could not be reached for comment Thursday. But N.C. Hudson warned that if McMannByrd doesn't show up to explain her actions or make arrangements to do so soon she will be held in contempt of court and warrants will be issued for her arrest.

"I should have had her arrested Hudson said Tuesday, when he scheduled the hearing. It was unclear Thursday whether McMann-Byrd would appear at today's hearing. Her attorney, Keith Bishop, said he had been in contact with McMann-Byrd, but he declined to say whether she would show up. Bishop contends that McMannByrd was snared in an internal court dispute over money and that the court has tried to use its power to strong-arm her into accepting poverty wages. "She's not a slave," Bishop said.

The dispute began this past fall after Hudson ordered McMannByrd to make one original and three copies of the Boggess trial transcript, an estimated 10,000 pages. In August, after she had turned in part of the transcription and been paid, the state's Administrative Office of the Courts told McMannByrd that it would no longer pay for the amount of work she was doing. Instead, it wanted only one original and one copy. Moreover, Bishop said, the office wanted her to reimburse it for the money they already had given her for the partially completed transcript. "This creates a dilemma for her," Bishop said.

District Court Judge William Fullwood said Thursday that in 1992, she stormed into a courtroom where he presided. She then went nose to nose with another lawyer outside in the lobby. Fullwood said he directed a deputy sheriff to put Daye in a small room while he looked for someone to take care of her.

Finding no one, he signed commitment papers sending her to Dorothea Dix Hospital. In August, the State Bar put Daye on "disability inactive status." She still has a license to practice law, but she is prohibited from doing so until she can satisfy the State Bar that she is competent. By the time she found out, Bishop said, Byrd-McMann had hired people to help her and could no longer pay them, let alone support herself. Worse, he said, she had been in a traffic accident that hampered her ability to use one of her hands.
